Privacy Notice

I. Identity and Address of the Controller


Niqera S. de R.L. de C.V. (hereinafter "NIQERA" or "the Controller"), with address in Apodaca, Nuevo León, Mexico, is responsible for processing your personal data pursuant to the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP 2025) (Ley Federal de Protección de Datos Personales en Posesión de los Particulares), published in the Federal Official Gazette on March 20, 2025, effective March 21, 2025.

II. Personal Data We Collect


2.1 Identification and contact data

  • Full name or company name
  • RFC and/or CURP (Mexican tax/ID numbers)
  • Tax address and/or service delivery address
  • Corporate and/or personal email address
  • Fixed and/or mobile phone number
  • Position or role within the organization

2.2 Data for contractual and tax formalization

  • Tax Situation Certificate (Constancia de Situación Fiscal — SAT)
  • Tax regime and economic activity code
  • Number of employees and organizational structure
  • Information about systems and technology platforms in use
  • Signed contractual documents

2.3 Data generated during service delivery

  • Temporary access to client systems granted
  • Information about operational processes, workflows, and data structure
  • Communication records (email, WhatsApp, video calls)
  • Technical, functional, and business requirements

2.4 Browsing data on www.niqera.com

  • IP address
  • Browser type and operating system
  • Pages visited and time spent
  • Cookies and tracking technologies (see section VII)

2.5 Sensitive data

NIQERA does not collect sensitive personal data (personal financial, medical, biometric, racial origin, sexual preferences, or political affiliation data) as part of its ordinary services. In the unlikely event that processing such data becomes necessary, we will request your express written consent.

III. Purposes of Processing


3.1 Primary Purposes (necessary for the contractual relationship)

  1. Identification and validation of customer, supplier, or prospect identity
  2. Preparation of quotes, technical proposals, and service contracts
  3. Issuance of invoices (CFDI 4.0) and digital tax receipts in accordance with SAT
  4. Execution of technology implementation, automation, consulting, and infrastructure projects
  5. Payment management, collections, and tax compliance
  6. Operational communication during project development
  7. Post-sale technical support and warranty management
  8. Compliance with legal, tax, and regulatory obligations

3.2 Secondary Purposes (subject to consent)

  1. Sending commercial communications, newsletters, and service updates
  2. Invitations to events, webinars, or product demos
  3. Satisfaction surveys and market research
  4. Generation of success stories and commercial references (with express authorization)

If you do not want your data processed for secondary purposes, you may indicate this by sending an email to [email protected] with the subject "Opt-out secondary purposes" within 5 business days of receiving this notice or at any later time.

IV. Transfer of Personal Data


NIQERA may transfer your personal data to third parties in the following cases:

NIQERA does not sell, transfer, or commercialize personal data to third parties for purposes other than those described herein.

V. ARCO Rights and Exercise Mechanism


You have the right to:

  • Access your personal data held by NIQERA
  • Rectify your data when it is inaccurate, incomplete, or outdated
  • Cancel the processing of your data when it is no longer necessary for the stated purposes
  • Object to the processing of your data for secondary purposes or when you have legitimate cause

ARCO Rights Exercise Procedure

  1. Send your request to [email protected] with the subject "ARCO Request"
  2. Include: full name, description of the right you wish to exercise, copy of official ID, and, where applicable, documents supporting your request
  3. NIQERA will respond within a maximum of 20 business days from receipt of the request
  4. If the request is approved, changes will take effect within the following 15 business days

If you disagree with the response, you may file a complaint with the Secretaría de Anticorrupción y Buen Gobierno (SABG) (Anti-Corruption and Good Governance Ministry) through its Personal Data Protection Unit, the competent authority in this matter since March 21, 2025 (replacing the former INAI). VI. Consent


By providing your personal data through any channel (web form, email, WhatsApp, phone call, or contract signature), you grant your consent for the processing described in this notice for the primary purposes.

For secondary purposes, consent will be requested expressly and independently.

VII. Use of Cookies and Tracking Technologies


The site www.niqera.com uses cookies to:

  • Ensuring the technical functioning of the site (essential cookies)
  • Analyzing browsing behavior using analytics tools (Google Analytics or equivalents)
  • Remembering user preferences

You may configure your browser to reject cookies or be notified when they are used. Disabling non-essential cookies will not affect your access to the site or NIQERA's services.

VIII. Security Measures


NIQERA adopts technical, administrative, and physical measures to protect your personal data against loss, theft, unauthorized use, alteration, or destruction:

  • Storage on servers with encryption at rest and in transit (TLS 1.2+)
  • Restricted access with two-factor authentication for authorized personnel
  • Internal confidentiality policies for employees and suppliers
  • Periodic backups on encrypted infrastructure (AWS S3)
  • Continuous monitoring of access and incidents

In the event of a security breach that significantly affects your property or moral rights, NIQERA will notify you immediately as established by the LFPDPPP.

IX. Changes to the Privacy Notice


NIQERA reserves the right to modify this notice at any time. Changes will be published at www.niqera.com/aviso-de-privacidad and will take effect the day following publication.

You are considered to accept the changes if you continue using our services after the publication date.
